In the following sections you can read which terms that are applicable when you use Able, as well as the terms when you create an account. This is to be considered a legal agreement between Able and you, who is using the service.
The Able service is operated by Able Health ApS, CVR DK38611933, Esromgade 15, 2200 Copenhagen N, Denmark (referred to as “Able”).
By using our service, personal data will be collected from you regarding: full name, email address, gender, age, height, weight, goal weight and activity level. Depending on your use of the service, we can collect personal data regarding your dietary habits and preferences, in order for the service to be optimized optimally for you and your needs.
We are always interested in improving our service, and we might therefore collect further personal data about you. If that is the case, you will be notified when the collection of the personal data takes place.
The use of your personal data
Your personal data is also used for customer support and marketing. By registering with Able, you will be subscribed to our mailing list, which aims to inform you about Able and help you get off to a good start as a member. If you do not wish for Able to use your personal data (including your email address) with the aim of direct marketing, you can always unsubscribe and not receive any further messages. This is done by clicking the “unsubscribe” link in the bottom of one of our emails.
At Able we do not share your personal data with a third party without your permission, except for in these limited situations: The collected personal data can be shared with a few selected affiliates. In addition, we reserve the right to disclose your personal data in compliance with a legal or administrative obligation. We can do this if we consider that this is required by law, or in order to protect and defend Able and our stakeholders.
It can also happen that data can be collected from other mobile applications, such as the “Health” app from Apple. Relevant data will be collected to increase the experience for you as a member. In these cases, however, you will usually have to give permission for us to collect the data from the specific apps.
Security of your personal data
The security of your personal data is an extremely important priority to us, which is why we use accepted industry standard technologies and procedures, such as firewalls and security software, in order to protect your personal data as best as possible.
However, no security system is 100% secure, which is why there will always be a risk of unauthorized access to your personal data. By using our service, you accept this risk.
The age limit for using Able is 15 years of age. The service is not aimed at children below the age of 15, and we do not knowingly collect data from here. If you are below the age of 15, we ask you to not send personal data through our service.
Membership and user account
Access to the offered services at Able requires a registered user profile. An Able membership is established and will be valid when the member signs in for the first time, either via Facebook or by creating a member profile via email address. The member can receive a free trial for 14 days, after which payment is made as part of the final registration as a member. After that, the member can make use of the services offered by Able, and payment will be due each month, every 3rd month or yearly.
Your membership at Able is automatically renewed by the end of the period, until it is actively cancelled. In order to make use of the service you will need to have access to the internet, a compatible device, such as a tablet or a smartphone, as well as a current, valid and accepted method of payment that you are always able to update. Unless you cancel the membership 24hrs before the billing date, you give Able permission to withdraw payment for the following period’s membership via the disclosed payment method.
You have the right to cancel your Able membership at any time. Be aware, that by uninstalling the app you are not closing down your account, nor have you cancelled your subscription. You have to actively cancel it yourself through Apple App Store or Google Play.
Able reserves the right at all times to refuse or terminate any user profile without the need for an explanation and without notice.
Able and our services
Able is a service developed and delivered by Able Health ApS. The service is available online at Ableapp.co, in the Apple App Store as “Able” and in Google Play as “Able”. The purpose of Able is to help members achieve a weight loss with a large selection of recipes and more.
Payment is made via Apple App Store or Google Play. As partners, they handle the payments through their service, and their payment terms apply in that regard. Able has no access to your payment information at any time.
The Able subscription includes a 14 day free trial, where you are able to try out Able for free. Able withdraws the first payment only after the expiration of the trial. If you cancel your subscription at least 24hrs before the expiry date, the trial has been completely free.
It is not possible to receive a refund, since Able offers this free trial where you are able to test and evaluate the product fully. As a digital product, no right of cancellation is provided. This applies to memberships of all durations. The membership can be terminated from the next subscription period.
Specific obligations and rights of the user
The user agrees that all data provided by the user is correct, so that Able can provide the correct service in terms of services offered and paid for. All information given to Able is treated confidentially, and Able’s liability is depreciated if the information provided is incorrect, as the user will not be properly instructed.
You always have the right to enquire about what personal data we have about you, and ask us to update and/or rectify any outdated or incorrect data. Able is obligated to inform you once a year, free of charge, whether or not personal data about you is being processed. Please contact Able, if you wish to exercise this right. The application must be in writing and signed by you.
You also have the right to request a deletion of all your data. You can contact our customer support at [email protected], if you wish to exercise this right.
Disclaimer for Able
As a user of Able you accept that the service is used at your own responsibility. The service is delivered without guarantees as it appears and as it is available. Able does not guarantee that the service, as well as its availability, will be flawless or uninterrupted. The service will continuously be improved and maintained, which means that continuous updates are to be expected. It is recommended that you always use the latest updated version of the service in order to ensure optimal use. Able accepts no responsibility for errors or omissions in information, software nor in any other document.
In addition, Able disclaims all guarantee of any kind for merchantability and fitness for a particular purpose. No guarantee is given that the service will meet your requirements and expectations in achieving goals and results, as no physical measures has been taken that can calculate your exact needs. Therefore, the service is based on an estimate. In addition, there is no guarantee of the accuracy, quality and reliability of the information obtained.
Able can not be held liable for direct or indirect injuries and consequential injuries caused by the use of our service. However, this is excluded in case of intentional action or gross negligence.
You agree to indemnify the company, its employees, as well as affiliates from and against any liability, injury, loss, claim and expense of any kind.
Our communication with you is via email and push notifications. You can switch off both services at any time, if you do not wish further communication. Please be aware however, that you will still receive replies to your questions and inquiries sent to our customer support via your email address.
